1. BayLine and contact details
Supplier: BayLine Transfers, South Africa. Registration number: 2026/750628/07.
Admin office: Shop 67, Langeberg Mall, Louis Fourie Road, Voorbaai, Mossel Bay. Phone / WhatsApp: 082 045 7180. Email: Bookings@baylinetransfers.com. Website: baylinetransfers.com.
BayLine provides pre-arranged private passenger transfer services in Hartenbos, Mossel Bay, George Airport and surrounding Garden Route service areas, subject to availability, operating authority and the service limits shown at the time of booking.
2. Acceptance and booking contract
Before a customer can submit an online booking through the BayLine booking page, the customer must tick the checkbox confirming that they have read and accept these Terms & Conditions. The Terms remain available through the BayLine website footer and at baylinetransfers.com/terms.
A booking contract is formed when BayLine issues a booking confirmation/reference for a confirmed transfer. A request that is expressly shown as “request only” is not a confirmed booking until BayLine approves it.
The version of the Terms displayed on the BayLine website at the time the booking is made applies to that booking, subject to any mandatory rights or obligations imposed by law.
3. Service and booking confirmation
Customers must provide accurate contact details, pickup and destination information, passenger numbers, luggage quantities, requested pickup time and, where relevant, flight information. BayLine may contact the customer to clarify operational details.
Requested pickup times are subject to vehicle and driver availability. If the selected time cannot reasonably be met, BayLine may offer the earliest feasible alternative time. Pickup requests from 23:30 inclusive until 05:00 exclusive are request-only and require BayLine approval before a driver is assigned.
BayLine may refuse or cancel a booking where carrying the passenger, luggage or requested items would be unsafe, unlawful, outside the supported service area or beyond the practical capacity of the available vehicle.
4. Fares and route changes
The fare shown and accepted for a normal booking is the agreed fare for the passenger's stated pickup location to destination. The driver's travel to the passenger is not added to the passenger fare unless a separate charge is expressly disclosed and agreed.
The quoted fare may include approved fixed-route pricing, distance-based pricing, passenger-count surcharges, night surcharges and other charges displayed before confirmation. A customer-requested extra stop, destination change, material detour, extended waiting time or other change after confirmation may result in an additional reasonable charge disclosed as soon as practicable.
Prices are stated in South African Rand. Where a technical error results in an obviously incorrect fare, BayLine may correct the error before the transfer begins and the customer may accept the corrected fare or cancel without charge if the error was BayLine's.
5. Payment
BayLine accepts cash or card machine in the car. A preferred method may be selected when booking, but the actual method used is recorded when the trip is completed.
Card payment is treated as completed only after the physical card terminal confirms approval. Bank transfers and proof-of-payment documents are not accepted as payment for new trips. The customer remains responsible for the agreed fare and any properly incurred additional charges.
6. Passengers and luggage
The launch vehicle is a standard VW Polo with a maximum of 3 passengers excluding the driver. The standard booking limit is 2 large suitcases; cabin/small bags must be declared separately.
The customer is responsible for declaring passenger numbers and luggage accurately. BayLine may refuse unsafe loads or items that cannot be carried safely. Undeclared or excessive luggage may require a different arrangement and may result in delay, refusal of carriage or an additional charge if an alternative can be arranged.
7. Airport collections
For George Airport collections the customer must provide the correct arriving flight number. BayLine may use airline, airport or third-party flight information to help adjust the operational pickup time, but such information can be delayed or inaccurate and is not guaranteed by BayLine.
The included period and any further waiting remain subject to driver availability, safety and the practical effect on other confirmed bookings. BayLine may leave the airport after reasonable attempts to contact the passenger if continued waiting is no longer reasonably possible.
If the customer supplies an incorrect flight number, no flight number where one is required, or fails to advise BayLine of a material itinerary change, BayLine may calculate waiting from the booked pickup time or other reasonable operational time and may treat the passenger as a no-show where appropriate.
8. Normal waiting time
Waiting is subject to driver availability and safety. If the passenger cannot be contacted, does not arrive within a reasonable period, or continued waiting would materially affect another confirmed transfer, BayLine may end the wait and apply the applicable waiting and/or no-show provisions.
9. Cancellation and no-shows
For a confirmed transfer, BayLine's standard cancellation schedule is:
- More than 24 hours before pickup: no cancellation fee.
- 6 to 24 hours before pickup: up to 50% of the agreed transfer fare.
- Less than 6 hours before pickup or a passenger no-show: up to 100% of the agreed transfer fare.
An overnight booking that is still only a request and has not yet been confirmed may be cancelled without a cancellation fee.
Any cancellation charge remains subject to applicable South African consumer law and will not exceed an amount that may lawfully and reasonably be charged in the circumstances. If BayLine cancels a confirmed transfer, any amount already paid for that transfer will be refunded, subject to the payment method and processing arrangements. BayLine is not responsible for consequential costs such as alternative transport, flights or accommodation except to the extent required by law.
10. Delays and missed connections
BayLine aims to provide punctual service but journey and arrival times cannot be guaranteed. Traffic congestion, accidents, roadworks, road closures, weather, airport operations, police activity, breakdowns, emergencies and the conduct of third parties can cause delay.
The customer must allow a reasonable safety margin for flights, appointments, cruises, tours, events and onward travel. To the maximum extent permitted by law, BayLine is not liable for indirect or consequential loss arising from a delay or missed connection caused by circumstances outside BayLine's reasonable control.
11. Passenger conduct and safety
Passengers must wear seat belts where required, comply with lawful safety instructions and behave in a manner that does not endanger the driver, vehicle, other passengers or road users. Children must travel in accordance with applicable legal restraint requirements; the customer must notify BayLine in advance of any required child-seat arrangement.
BayLine or the driver may refuse to start or may terminate a transfer if a passenger is violent, threatening, abusive, dangerously intoxicated, interferes with the driver, carries unlawful or dangerous items, deliberately damages the vehicle or creates a material safety risk. The customer remains responsible for charges reasonably incurred up to that point and for damage caused by the passenger.
12. Personal belongings
Passengers are responsible for passports, travel documents, money, phones, electronics, medication, luggage and other personal property. BayLine will take reasonable care of property placed in its custody but does not accept responsibility for ordinary loss, theft or damage caused by the passenger, another passenger, third-party crime or circumstances outside BayLine's reasonable control.
Any found property will be handled reasonably. Collection, courier or delivery costs for returning lost items may be charged to the passenger.
13. Cleaning and vehicle damage
The customer is responsible for reasonable cleaning, repair or replacement costs caused by deliberate or negligent damage, abnormal soiling, vomiting, smoking/vaping where prohibited, spillage, contamination or misuse by the passenger or people in the passenger's group, beyond ordinary wear and tear. BayLine may require reasonable evidence of such costs.
14. Liability, injury and death
Road travel carries inherent risk. This includes the possibility of collision, bodily injury, permanent disability and death arising from normal road hazards, the acts or omissions of other road users, road conditions, weather, criminal conduct, emergencies and events that BayLine cannot reasonably control.
To the maximum extent permitted by South African law, BayLine, its owners, employees, drivers and authorised agents will not be liable for loss, injury, death, damage, delay or expense caused by:
- the negligent, unlawful or intentional acts of another road user or unrelated third party;
- road defects, road closures, traffic control, weather, natural events, civil disturbance, crime or other circumstances outside BayLine's reasonable control;
- the passenger's own act or omission, failure to follow a lawful safety instruction, inaccurate booking information, prohibited item, or failure to use an available seat belt or required restraint;
- loss of profit, business, opportunity, enjoyment, itinerary, ticket value or other indirect or consequential loss, except where such exclusion is not permitted by law.
For direct contractual or property loss that does not involve personal injury or death, and only to the extent permitted by law, BayLine's aggregate liability arising from a particular transfer will be limited to the amount paid or payable for that transfer, unless a greater liability is imposed by law.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. This includes any liability that applicable law imposes despite a contractual limitation, and any liability arising from conduct for which exclusion is prohibited by law.
15. Passenger indemnity
To the maximum extent permitted by law, the customer indemnifies BayLine against third-party claims, losses, penalties, cleaning costs or property damage arising from the customer's or passenger's breach of these Terms, unlawful conduct, dangerous or prohibited items, materially inaccurate information, or intentional/negligent damage to property. This indemnity does not apply to the extent a claim was caused by BayLine's own conduct for which liability cannot lawfully be excluded.
16. Insurance and statutory claims
BayLine may maintain insurance appropriate to its operations. The existence of insurance is not an admission of liability, and any insurance claim remains subject to applicable policy terms, factual investigation and South African law.
These Terms do not contract a passenger out of any non-waivable statutory right or claim, including any right that may arise under applicable road-accident legislation. A passenger, dependant or other claimant must follow the legal requirements of the relevant statutory or insurance process.
17. Medical and accessibility needs
BayLine is a private passenger transfer service and is not an ambulance, emergency medical service or specialist medical transport provider. Passengers should advise BayLine in advance of accessibility requirements, mobility equipment or assistance reasonably needed for the transfer. BayLine will advise whether the available vehicle and service can safely accommodate the request.
Passengers remain responsible for medication and for determining whether ordinary private passenger transport is appropriate for their condition. In an emergency, passengers should contact the appropriate emergency services.
18. Replacement vehicles and authorised operators
Where reasonably necessary because of breakdown, availability, safety or operational disruption, BayLine may provide a suitable replacement vehicle or use an appropriately authorised service provider, subject to applicable legal, safety and insurance requirements. BayLine remains responsible for its own contractual obligations to the extent required by law.
19. Events beyond reasonable control
BayLine is not in breach for a failure or delay caused by an event it could not reasonably prevent or overcome, including severe weather, flooding, fire, major road closure, civil unrest, strike, government restriction, infrastructure outage, widespread communications failure, emergency response activity or comparable event. BayLine will take reasonable steps to communicate and mitigate the effect where practicable.
20. Privacy and personal information
BayLine processes personal information reasonably required to quote, book, operate, support and account for transfers. This may include name, contact information, pickup/destination details, booking time, flight number, luggage information, payment status, service communications and trip information. Driver/vehicle location may be processed for dispatch, availability, ETA, customer tracking, safety and kilometre reconciliation.
BayLine uses role-based access and reasonable technical and organisational safeguards intended to protect personal information. Information may be shared with service providers only where reasonably necessary for functions such as hosting, mapping, messaging, flight information, payment processing, accounting or legal compliance. BayLine does not sell passenger information.
Customers may request access to or correction of their personal information and may raise privacy questions at Bookings@baylinetransfers.com. BayLine will process such requests subject to POPIA and other applicable law.
21. Complaints and disputes
Customers are encouraged to contact BayLine promptly so that a booking, fare, waiting-time, driver, payment, property or service concern can be investigated while information is still available. Contact BayLine on 082 045 7180, WhatsApp 082 045 7180 or email Bookings@baylinetransfers.com.
Nothing in these Terms removes a consumer's right to use an applicable ombud, regulator, tribunal or court where the law provides that right.
22. Electronic transactions
BayLine bookings made through the website are electronic transactions. Before submission, the booking interface presents the route, pickup time, passenger/luggage details, fare and payment choice and requires acceptance of these Terms. Customers should correct any error before confirming.
These Terms are available electronically at the website and can be stored or reproduced by saving or printing the page. Normal website and telecommunications charges imposed by a customer's own network provider remain the customer's responsibility.
23. General provisions
These Terms are governed by the laws of the Republic of South Africa. If a provision is invalid or unenforceable, it will be limited or severed only to the extent necessary and the remaining provisions will continue to apply.
BayLine may update these Terms for future bookings. A change does not retrospectively alter an already confirmed booking unless the parties agree or the law requires it.
